These Terms of Service (“Terms”) govern the supply of services by Liquid Light Whisperer Ltd and Liquid Light Lab. Please read them carefully before placing an order or purchasing a voucher.

Liquid Light Whisperer Ltd trades under the names Liquid Light Whisperer (photographic commissions and shoots) and Liquid Light Lab (film processing and scanning).
“We”, “us”, and “our” refer to Liquid Light Whisperer Ltd.
“You” and “your” refer to the customer placing an order, purchasing a voucher, or redeeming a service.
2) Scope of these Terms
These Terms apply to:
All film processing and scanning services provided by Liquid Light Lab, including C-41, black & white, and ECN-2.
The purchase and redemption of Large Format Shoot Vouchers offered by Liquid Light Whisperer.
Weddings, portraits, editorial work, and other commissioned shoots (other than voucher-based sessions) are governed by separate service-specific agreements issued at the time of booking.
3) Orders, pricing, and turnaround times
All prices are stated in GBP and may change at any time prior to checkout.
Turnaround times published on the website or communicated by email are estimates only and not guaranteed. Delays may occur due to workload, equipment maintenance, supply constraints, or technical factors inherent in analogue processing.
We reserve the right to refuse, cancel, or limit any order. Where payment has been taken, refunds will be issued in accordance with Section 11.
4) Customer warranties and declarations
By placing an order or sending film to us, you warrant and confirm that:
You own the copyright in the film submitted, or you have written permission from the copyright holder.
The content of the film does not infringe any law or third-party rights.
You have accurately identified the film type and required process (for example, C-41, ECN-2, or black & white).
Film that is mislabelled or incorrectly ordered may be returned unprocessed or processed at your sole risk. We are not responsible for damage or loss arising from incorrect service selection.
5) Film handling, inherent risk, and limitation of liability
We handle all film with reasonable care and in accordance with professional laboratory practice. However, film is a unique physical medium and carries inherent risk.
If film is lost or damaged while in our care, our total liability is strictly limited to the lower of:
The current retail price of equivalent unexposed film, or
The amount you paid for the relevant processing service.
We do not accept liability for indirect, consequential, or special losses, including (without limitation) loss of income, missed commissions, travel costs, reputational harm, emotional distress, or data loss.
We are not responsible for defects or issues originating before receipt of your film, including but not limited to light leaks, expired stock behaviour, age fog, storage damage, camera faults, manufacturer defects, or postal damage prior to arrival.
Nothing in these Terms limits or excludes liability where doing so would be unlawful under UK law.
6) Shipping, transit risk, and negative returns
You are responsible for shipping film to us. Risk of loss or damage in transit to us remains with you. We strongly recommend tracked and appropriately packaged postage.
Return of negatives is by the method selected at checkout. Risk passes to you once the package is handed to the carrier.
If return postage has not been paid and negatives remain unclaimed for 90 days, we will make one attempt to contact you. If no response is received within a further 30 days, we reserve the right to securely store or dispose of the materials at our discretion.
7) Scans, file delivery, and retention
Scanning specifications are published on our website and form part of the service description.
Digital files are delivered electronically via WeTransfer or an equivalent service. Download links remain active for 60 days from issue.
Prior to delivery, scans are stored on a secure RAID system for redundancy and upload management. After delivery, files are retained for 30 days solely to facilitate re-delivery if required. After this period, all files are permanently deleted and cannot be recovered.
You are responsible for downloading, backing up, and archiving your files.
8) Colour, density, and re-scans
Colour balance and density involve professional judgement. We supply a consistent, technically correct baseline render.
One reasonable re-scan per roll is included only where a clear technical error has occurred (for example, incorrect framing, gross colour cast, or clipping). Requests based on creative preference or aesthetic interpretation may incur an additional fee.
9) Photoshoot Shoot Vouchers (Liquid Light Whisperer)
Vouchers constitute pre-paid credit for the specific session described on the relevant product page or receipt.
Booking: Subject to availability. Reasonable alternative dates will be offered where necessary.
Inclusions: Defined exclusively by the voucher description and receipt.
Validity: Unless stated otherwise, vouchers are valid for 12 months from purchase. Extensions are discretionary and may incur a fee.
Transfer: Vouchers may be gifted but may not be resold without our written consent.
Cancellations: One re-booking is permitted without charge with at least 7 days’ notice. Shorter notice may incur a re-booking fee.
Force majeure: We may reschedule for safety, technical, or operational reasons. Liability is limited to re-booking or refund of the voucher price.
10) Refunds, cooling-off rights, and incorrect orders
Processing services: Once film has been received and processing has begun, refunds are not available except where required by law.
If you order an incorrect service, we will contact you. The correct service must be paid for before any refund is issued for the incorrect order. If you choose not to proceed, your film will be returned and the incorrect order refunded minus shipping, packaging, and any non-refundable payment processing fees.
Vouchers: Unused vouchers are subject to a 14-day cooling-off period under the Consumer Contracts Regulations. After this period, vouchers are non-refundable but may be redeemed within their validity.
Refunds are always net of postage already incurred and third-party payment processing fees unless otherwise required by law.
11) Intellectual property and licences
You retain full copyright in your images.
By submitting film, you grant us a limited, non-exclusive licence to process, scan, temporarily store, and deliver your images solely for the purpose of fulfilling your order.
No promotional or public use will be made without your explicit consent.
12) Privacy and data protection
We process personal data only as necessary to fulfil orders and communicate with customers. Full details are set out in our Privacy Policy, including lawful bases, retention periods, and your statutory rights.
13) Prohibited use
You must not use our services or website for unlawful purposes, infringement of rights, or the transmission of malicious code or materials.
14) Service availability and changes
We may modify, suspend, or discontinue services, specifications, or pricing at any time. Published descriptions are indicative and do not constitute contractual guarantees.
15) Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
16) Changes to these Terms
We may update these Terms by publishing a revised version on our website. Continued use of our services after publication constitutes acceptance of the updated Terms.
